Annex. 1: Standard form of the contract cancellation
- 1 Definitions
Working days – days from Monday to Friday except the public holidays.
Account – a free Store function (service provided electronically) that is regulated in separate Terms & Conditions, thanks to which the Buyer can set up an individual account in the Store.
Consumer – Consumer within the meaning of the Civil Code.
Buyer – every buyer in the Store.
Terms & Conditions – these regulations.
The Store – online Store Decorative Skins Janosik run by the Seller at https://sklep493052.shoparena.pl.
Seller – Adam Fic, an entrepreneur running a business under the name of Firma A.F. Adam Fic, entered into the Central Register and Information on Economic Activity kept by the minister competent for economy and keeping the Central Register and Information on Economic Activity, NIP 7352876143, nr REGON 369804698, os. Nowe 41a 34-400 Nowy Targ.

- 3 Technical requirements
- For the proper functioning of the Store, the below is needed:
- - A device with Internet access
- - A web browser that supports JavaScript and cookies.
To make an order in the Store, in addition to the requirements stated in paragraph 1, an active e-mail address is required.
- 4 Shopping in the Store
- The prices of goods in the Store are total prices for the goods, including VAT.
- The Seller points out that the total price of the order consists of: the items price and, if applicable, the costs of delivery.
- The chosen goods have to be added to the cart in the Store.
- Then the Buyer selects from the available in the Store: the method of delivery and the method of payment for the order and also provides the necessary data to complete the order.
- The order is placed upon confirmation its content and acceptance of the Terms & Conditions by the Buyer.
- Placing an order is identical to concluding a sales contract between the Seller and the Buyer.
- The Seller shall provide the Consumer a confirmation of conclusion of sales contract on a durable medium at the latest upon delivery of the goods.
- The Buyer can register in Store, which means - create an account or make a purchase without registration by providing the data with each possible order.
- 5 Payments
- The Buyer can pay for the order, depending on the choice:
- by ordinary transfer to the Seller’s bank account
- Via the payment platform :

- TPay.com
- cash on delivery upon delivery of the goods to the Buyer.

- If you choose to pay via payment platform Shopper Payments, Blue Media S.A. is the subject providing online payments service.
- If the Buyer chooses to pay in advance, the order must be paid for within 4 working days from the date of placing the order.
- The Seller informs that in the case of some payment methods, due to their specificity, payment for the order is possible only immediately after placing an order.
- By making purchases in the Store, the Buyer accepts the use of electronic invoices by the Seller. The Buyer has the right to withdraw his acceptance.
- 6 Order fulfilment
- The Seller is obligated to deliver the goods without any defects.
- The time limit for fulfilment of the order is stated in the Store.
- If the Buyer has chosen payment in advance, the Seller will proceed with the order after the payment.
- In a situation when the Buyer purchased goods with different delivery dates under one order, it will be processed on the date appropriate for the goods with the longest delivery date.

- 7 The right to cancel the contract
- The Consumer has the right to cancel the contract concluded with the Seller via Store, subject to §8 of the Terms & Conditions, within 14 days without giving any reason.
- The deadline to cancel the contract expires after 14 days from the day:
- on which the Consumer acquired the goods or on which the third party other than the carrier and indicated by the Consumer came into possession of the goods.
- On which the Consumer came into possession of the last item or on which the third party other than the carrier and indicated by the Consumer, came into possession of the last item. In the case of the contract requiring the transfer of ownership of many items, which are delivered separately
- on which the contract was concluded – in the case of a contract for the supply of digital content.
- In order for the Consumer to use the right to cancel the contract, he must inform the Seller, using the data provided in § 2 of Terms & Conditions, about his decision to cancel the contract with a clear statement (e.g. letter sent via post or information sent by e-mail).
- The Consumer may use the standard form of contract cancellation placed at the end of Terms & Conditions, although it is not obligatory.
- In order to meet the deadline for contract cancellation it is enough for the Consumer to send an information concerning the use of his right to cancel the contract before the deadline to do so.
THE EFFECTS OF CONTRACT CANCELLATION
- In the event of cancelling the contract, the Seller returns the Consumer all received payments, including the costs of the delivery (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard delivery offered by the Seller), immediately, in each case, not later than 14 days from the date the Seller was informed about the Consumer’s decision to cancel the contract.
- The Seller will make a refund using the same method of payment that was used by the Consumer in the original transaction, unless the Consumer agrees on a different solution, in each case the Consumer will not incur any fees due to the refund.
- The Seller may withhold the refund until receipt of the goods or until the proof of its return is provided, depending on which occurs first.
- The Seller asks for goods return to the address: os. Nowe 41a 34-400 Nowy Targ, immediately, in each case, not later than 14 days from the date on which the Consumer informed the Seller about the contract cancellation. The deadline is met if the Consumer returns the goods before the deadline of 14 days.
- The Consumer incurs the direct costs of the items return.
- The Consumer is liable only for the decrease in the value of the goods resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the goods.
- If the goods, due to their nature, cannot be send back via regular post, the Consumer will also have to bear the direct costs of returning the goods. The Consumer will be informed about the estimated amount of these costs by the Seller, in the description of goods in the Store or when placing an order.
- 8 The exceptions of the right to cancel the contract
- The right to cancel the distance contract shall not be granted to the Consumer in respect to the contract:
- in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer’s specification or serving to satisfy his individual needs
- in which the subject of the service is an item that deteriorates quickly or has a short shelf life.
- in which the subject of the service is an item delivered in sealed package, which cannot be returned due to health protection or hygienic reasons, if the packaging has been opened after the delivery.
- in which the subject of the service is an item, which after the delivery, due to their nature, remain inextricably linked to other items.
- in which the subject of the service are sound or visual recordings or computer software, delivered in sealed package, if the package has been opened after the delivery.
- For the delivery of newspapers, periodicals or magazines, with the exception of subscription contracts.
- in which the price or wages depend on fluctuations on the financial market over which the entrepreneur does not have any control and which can occur before the deadline of contract cancellation.
- For the delivery of digital content, that is not stored on material medium, if the performance began with the Consumer’s explicit consent before the deadline to cancel the contract and after informing him by the entrepreneur about the loss of the right to cancel the contract.
- The right to cancel the distance contract shall not be granted to any party other than the Consumer.
- 9 Complaints
- In the event of the item’s defect, the Buyer has the possibility to make a complaint about the defective item, on the basis of the warranty settled in Civil Code or guarantee, provided that the guarantee has been granted.
- Using the warranty, the Buyer can, on terms and within the time limits specified in Civil Code:
- Submit a price reduction statement
- In the event of significant defect – submit a cancellation of the contract
- demand the replacement of the item free from defects
- demand the defect removal
- The Seller asks for submitting a complaint based on the warranty to the postal code or electronic address indicated in § 2 Terms & Conditions.
- If it turns out that, in order to consider the complaint, it is necessary to deliver the items to the Seller, the Buyer is obligated to deliver the items, in the case of Consumer, at the Seller’s expense, to the address: os. Nowe 41a 34-400 Nowy Targ.
- If an additional guarantee has been granted, information about it and its conditions is also available in the product description in the Store.
- Complaints regarding the Store functioning should be send to the e-mail address indicated in in § 2 Terms & Conditions.
- Consideration of the complaint by the Seller will take place within 14 days.
Out-of-court methods of settling complaints and pursuing claims
8, In the event when the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, incl.:
a/ Mediation conducted by the competent Provincial Inspectorate of Trade Inspection, to which you should apply for a mediation. As a rule, the procedure is free of charge. The list of Inspectorates is available here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
- Assistance of a competent field-permanent consumer arbitration court operating at the Provincial Inspectorate of Trade Inspection, to which an application for consideration of a case before an arbitration court should be submitted. As a rule, the procedure is free of charge. The list of courts is available at: https://www.uokik.gov.pl/wazne_adresy.php#faq596.
- Free assistance of the municipal or county Consumer Ombudsman.
- Internet platform ODR available at: http://ec.europa.eu/consumers/odr/.
- 10 PERSONAL DATA
- The Seller is the administrator of personal data provided by the Buyer when using the Store.
- The Buyer’s personal data is processed on the basis of the contract and for its implementation, in accordance with the principals set out in the general regulations if the European Parliament and of the Council (UE) on data protection (RODO). Specific information regarding data processing by the Seller is included in the privacy policy in the Store.
- RESERVATIONS
- It is forbidden for the Buyer to provide illegal content.
- Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the regulations. The contract is concluded on time and for the purpose of order fulfilment.
- Contracts concluded on the basis of these regulations are concluded in Polish.
- In the event of a possible dispute with a Buyer who is not a Consumer, the competent court will be the court competent for the headquarters of the Seller.
- None of the provisions of these regulations does not exclude or in any way limit the consumer's rights under the law.
- Provisions regarding goods shall apply accordingly to digital content, unless the Terms & Conditions specify these issues separately.

§ 1 DEFINITIONS
Account - the free Store function (service) regulated in these regulations, thanks to which the Buyer may set up his individual Account in the Store.

- 3 Technical requirements
- For the proper functioning and setting up an Account, the below is needed:
- An active e-mail account
- A device with Internet access
- A web browser that supports JavaScript and cookies.
§ 4 Account
- The Account set up is completely voluntary and depends on the will of the Buyer.
- The Account gives the Buyer additional options, such as: viewing the history of orders placed by the Buyer in the Store, checking the order status or editing the Buyer's data.
- In order to create an Account, you need to complete the appropriate form in the Store.
- At the time of creating the Account, an agreement is concluded for an indefinite period of time between the Buyer and the Seller on the terms set out in the Terms & Conditions.
- The Buyer may at any time without incurring any costs cancel the Account.
- In order to cancel the Account the resignation is needed send by e-mail to: biuro@skoryjanosik.pl, which will result in the immediate removal of the Account and termination of the Account maintenance contract.
§ 5 COMPLAINTS
- Complaints regarding the Account functioning should be send to the e-mail address: biuro@skoryjanosik.pl
- Consideration of the complaint by the Seller will take place within 14 days.

- 7 RESERVATIONS
- It is forbidden for the Buyer to provide illegal content.
- The Account maintenance agreement is concluded in Polish.
- In the event of important reasons referred to in § 4, the Seller has the right to amend these Account regulations.
- Due to important reasons referred to in §3 are:

- the need to adapt the Store to the legal provisions applicable to the Store's activity,
- improving the security of the service provided,
- Changing the functionality of the Account that requires modification of the Account’s regulations.
- The Buyer will be informed about the planned change of the Account regulations at least 7 days before the change is implemented via an e-mail sent to the address assigned to the Account.
- If the Buyer does not accept the planned change, he should inform the Seller about it by sending an appropriate message to the Seller's e-mail address biuro@skoryjanosik.pl, which will result in the termination of the Account maintenance contract with the entry into force of the planned change or earlier if requested by the Buyer.
- If the Buyer does not object to the planned change until its entry into force, it is assumed that he accepts it, which does not constitute any obstacle to termination of the contract in the future.
- In the event of a possible dispute with a Buyer who is not a Consumer, the competent court will be the court competent for the headquarters of the Seller.
- Nothing in these regulations excludes or in any way limits the consumer's rights under the law.
Regulations of the newsletter of Decorative Skins Janosik Shop
§ 1 DEFINITIONS
Newsletter - a free service provided electronically, thanks to which the Service Recipient may receive from the Service Provider electronically previously ordered messages regarding the Store, including information about offers, promotions and new products in the Store.

Service Recipient - each entity using the Newsletter service.
§ 2 Newsletter
1. The Service Recipient may voluntarily use the Newsletter service.
2. To use the Newsletter service, it is necessary to have a device with the latest version of a web browser that supports JavaScript and cookies, with access to the Internet and an active e-mail account.
3. The e-mails sent as part of this service will be sent to the e-mail address provided by the Service Recipient when subscribing to the Newsletter.
4. In order to conclude a contract and subscribe to the Newsletter service, the Service Recipient shall first enter the e-mail address to which he wants to receive messages sent as part of the Newsletter. Then, to the e-mail address provided in the first step, the Service Provider will send the Service Recipient a message verifying the e-mail address, which will include a link to confirm the Service Recipient's will to subscribe to the Newsletter. After the Service Recipient confirms his will to subscribe to the Newsletter, a contract for the provision of the service is concluded, and the Service Provider will start providing it to the Service Recipient.
5. In the messages sent as part of the Newsletter there will be information about the possibility of unsubscribing from it, as well as a link to unsubscribe.
6 The Service Recipient may unsubscribe from the Newsletter without giving any reason and incurring any costs, at any time, using the option referred to in paragraph 5 or by sending a message to the Service Provider's e-mail address: biuro@skoryjanosik.pl.
7. Using the link to unsubscribe from the Newsletter by the Service Recipient or sending a message requesting unsubscribing from the Newsletter will result in immediate termination of the contract in the provision of this service.
§ 3 Complaints
- Complaints regarding the Newsletter should be send to the e-mail address: biuro@skoryjanosik.pl
- Consideration of the complaint by the Service Provider will take place within 14 days.
- 4 PERSONAL DATA
- The Service Provider is the administrator of personal data provided by the Service Recipient when using the Newsletter.
- The Buyer’s personal data is processed on the basis of the contract and for its implementation, in accordance with the principals set out in the general regulations if the European Parliament and of the Council (UE) on data protection (GDPR). Specific information regarding data processing by the Service Provider is included in the privacy policy in the Store.
- 5 Final provisions

- The Service Provider reserves the right to amend these regulations only for important reasons. An important reason is the need to change the regulations caused by the modernization of the Newsletter service or a change in the law, affecting the provision of the service by the Service Provider.
- Information about the planned change to the regulations will be sent to the Service Recipient‘s e-mail address provided at the time of subscribing to the Newsletter at least 7 days before the changes are implemented.
- 3. If the Service Recipient does not object to the planned changes until their entry into force, it is assumed that he accepts them.
- 4. In the event of non-acceptance of the planned changes, the Service Recipient should send information Service Provider's e-mail address: biuro@skoryjanosik.pl, which will result in the termination of the contract for the provision of the service upon the entry into force of the planned changes.
- 5. It is forbidden for the Customer to provide illegal content.
